Welcome to U-Sports, an interactive online service operated by Perimeter Consulting, Inc. By using this site, you signify your agreement to all terms, conditions, and notices contained or referenced herein ("Terms and Conditions of Use"). If you do not agree to these Terms and Conditions of Use, please do not use this site. Perimeter Consulting, Inc. reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms and Conditions of Use at any time. By using this site after notice of such changes is posted, you agree to be bound by the modifications, alterations or updates.

Copyright and Trademarks

U-Sports contains copyrighted material, trademarks and other proprietary information including, text, software, photos, video, graphics, music and sound. All content included on this site, such as text, software, photos, video, graphics, music, sound, and logos, is protected by copyrights, trademarks, and other rights, which are owned and/or controlled by Perimeter Consulting, Inc. or by other parties. Perimeter Consulting, Inc. owns a copyright in the selection, coordination arrangement and enhancement of such content, as well as the content original to it. You may use material from this site only for your own personal, non-commercial use. This site or any portion of this site may not be modified, published, reproduced, duplicated, copied, uploaded, downloaded, posted, transmitted, sold, or otherwise exploited for any commercial purpose that is not expressly permitted by Perimeter Consulting, Inc. or expressly permitted under copyright law. In the event of any permitted copying, redistribution, or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

Privacy Policy

Personal information provided to U-Sports will never be shared with any organization or U-Sports partner without your consent. By registering a fantasy team or signing up for the mailing list, you will receive occasional newsletters and team updates (trade proposals, etc.).

All league members are able to view the names and e-mails of other league members, including public leagues. Name and e-mail information can be edited at any time from within the team interface.

Prize Eligibility

U-Sports is offered as a form of entertainment only. All prizes are awarded based on a participant's exercise of knowledge and skill within the rules of the game. To be eligible to win a prize in U-Sports, you must be at least 18 years old as of August 30, 2008, and a legal resident of the United States. Residents of Arizona, Arkansas, Iowa, Louisiana, Maryland, Montana, North Dakota, Vermont, and US territories may play, but will not be eligible to win prizes. Florida residents are ineligible for the grand prize. Leagues who use a shortened season are not eligible for prizes beyond the free entry for next season awarded to the league champion. THIS CONTEST IS VOID WHERE OTHERWISE PROHIBITED OR RESTRICTED BY LAW. All employees, contractors and immediate family members of U-Sports and/or Perimeter Consulting their sponsors, advertising, production, and fulfillment agencies are not eligible for prizes. In addition, if you live in any other state or area where U-Sports fantasy games are unlawful, you agree that you may play, but you may not be eligible to win prizes. By signing up to play, you agree to be bound by all of the terms herein, as well as any applicable state or federal laws that apply to you.

U-Sports is not to be used in connection with any form of gambling or the promotion of gambling.

Prize Award Criteria

Prizes will be awarded based on the official U-Sports poll which assigns a score to each fantasy team based on their performance versus all other U-Sports teams. The complete details of the ranking system are described in the Rulebook.

Teams who are not eligible for prizes will be continue to be calculated and displayed in the Top 25, but only the Top 25 eligible teams will be used for the purposes of prize distribution.

If two prize-eligible teams are tied at the end of the season, the tie breaker will be highest ranking of the runner-up in the tied team’s league. In other words, the league with the better overall 2nd place team.

If more than one team qualifies to win the grand prize, the prize will be split amongst the winning teams.

Adjustments to scores by individual league commissioners are not included into the rankings. For example if Team A originally wins by 2 points, but their league commissioner adds 5 points to Team B's score, Team A is still credited with the win and Team B's original score is used to calculate the overall U-Sports ranking.

Any attempt by a team or league commissioner to alter or influence the overall U-Sports ranking will void prize eligibility and may lead to reduced privileges.

Chances of winning depend upon the total number of entries received and the skill used in choosing your players. Prizes are not transferable and must be accepted as awarded, no cash equivalents, no substitutes. All winners automatically grant to U-Sports the right to use their name, address (city/state) and photo for publicity without compensation. Taxes are the sole responsibility of the winners. Prize winners will be required to sign an affidavit of eligibility and a liability release within ten days of notification. In the event of non-compliance, the prize will not be awarded. Prizes cannot be shipped to P.O. boxes. Winners from Alaska and Hawai'i will be responisble for any additional shipping costs over and above the first thirty (30) dollars.

U-Sports may, at its sole discretion, substitute listed prizes for items of like value in the event that the described prizes are unavailable for any reason.

For a list of all winners, send a #10, SASE to U-Sports, 1860 Sandy Plains Rd. #204-180, Marietta, GA 30066 no later than January 31, 2009 (April 30, 2009 for basketball). Prizes awarded in U-Sports may be subject to legal restrictions. Entrants agree that in the event a legal authority challenges the award of prizes to winners of U-Sports, U-Sports has the sole right to determine whether or not to award such prizes and whether or not to refund previous payments.

Acceptable Conduct

U-Sports reserves the right to undo any actions or reduce privileges of any fantasy team account which violates fair play, attempts to circumvent the online application, or negatively impacts the fantasy sports experience for any other user.

Violations of acceptable conduct will be determined at the sole descretion of U-Sports. Examples of unacceptable conduct may include: Offensive message board postings, Collusion with another team owner, Any attempt to reverse engineer or export content from U-Sports, etc.

Payments

All teams in a league must have payment submitted before the league's draft can be processed. All sales are final. At U-Sports' discretion refunds may be made for certain circumstances but refunds cannot be made within a week prior to the team's draft or after fifteen (15) days from the original payment transaction.

If a private league does not have enough teams to fill prior to the start of the season, paid teams who are not eligible for a refund will be moved to a public league at no additional cost.

Interactive Areas

U-Sports' forums, bulletin boards and chat rooms are provided to give users interesting and stimulating forums in which they can express their opinions and share their ideas. By posting opinions, comments, or ideas on U-Sports, you grant Perimeter Consulting, Inc. a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, copy, reproduce, modify, display, adapt, publish, translate, create derivative works from, distribute, and display such reviews and comments throughout the world in any form, media, software or technology of any kind. You also grant Perimeter Consulting, Inc. the right to use your name in connection with the reproduction or distribution of such material.

You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions of Use or your use of this site shall be filed only in the state or federal courts located in the State of Georgia, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
